2、iveExaminationProcedureandGrantingPatentRight.（1）受理階段：專利局收到專利申請后進(jìn)行審查，如果符合受理?xiàng)l件，專利局將確定申請日，給予申請?zhí)枺⑶液藢?shí)過文件清單后，發(fā)出受理通知書，通知申請人。（1）FilingThePatentOfficestartsexaminationuponreceivingapatentapplication.Iftheapplicationisinconformitywiththerequirementoffiling,theP
3、atentOfficeshalldeterminethefilingdate,giveapplicationnumber.Afterverifyinglistofdocuments,thePatentOfficeshallnotifytheapplicanttheacceptanceofapplicationbyissuingtheFilingReceiptforPatentApplication.（2）初步審查階段：經(jīng)受理后的專利申請按照規(guī)定繳納申請費(fèi)的，自動進(jìn)入初審階段。在初審是要對申請是否存在明
4、顯缺陷進(jìn)行審查，主要包括審查內(nèi)容是否屬于《專利法》中不授予專利權(quán)的范圍，申請文件是否齊備及格式是否符合要求。發(fā)明專利申請初審合格的，將發(fā)給初審合格通知書。（2）PreliminaryExaminationProcedureAnacceptedpatentapplicationwillenterintothePreliminaryExaminationProcedureunconditionallywhiletheapplicationfeesarepaidbyregulations.InthisPro
5、cedure,theexaminationaimsatobviousdefectsexistsintheapplication.Themain3tasksaretoexaminewhetherornotthebodyoftheapplicationfallsintotheconditionofnottobegrantedpatentrightunderthePatentLawandwhetherornottheapplicationdocumentssubmittedbytheapplicantare
6、completeandareinconformitywiththerequirementsofPreliminaryExamination.IfapatentapplicationforinventionisdeemedtobeconformitywiththePreliminaryExamination,thePatentOfficeshallissuetheNotificationofPassingPreliminaryExamination.（3）公布階段：發(fā)明專利申請從發(fā)出初審合格通知書起進(jìn)入
7、公布階段。在初步審查合格之后，自申請日起滿18個月，即行公布。專利局也可以根據(jù)申請人的請求早日公布其申請。申請公布以后，申請人就獲得了臨時保護(hù)的權(quán)利。（3）PublicationUponissuingtheNotificationofPassingPreliminaryExamination,thePatentApplicationforInventionentersintotheStageofPublication.AfterpassingthePreliminaryExamination,thea
