1、職務(wù)侵占罪的立案標準和構(gòu)成一、本罪的立案標準?????????1979年刑法未作規(guī)定。本罪是從全國人大常委會1995年2月28日頒布實施的《關(guān)于懲治違反公司法的犯罪的決定》吸收為刑法具體規(guī)定的。1997年刑法第271條規(guī)定，“公司、企業(yè)或者其他單位的人員，利用職務(wù)上的便利，將本單位財物非法占為己有，數(shù)額較大的，處5年以下有期徒刑或者拘役：數(shù)額巨大的，處5年以上有期徒刑，可以并處沒收財產(chǎn)?！??????所謂利用職務(wù)上的便利，是指行為人利用自己在本單位所具有職務(wù)所產(chǎn)生的方便條件。對于將本單位財物非法占為己有，實踐中一般表現(xiàn)為侵吞
