2、Recentstudiesindicatethatthedefectsandshortcomingsoflandexpropriationhasproduced,owingtothelandutilizationbehavioroflocalgovernmentunderthe“l(fā)andfinance”,includingthedeficienciesoftheinstitutionaldesignoflaw,uncleardefinitionofpublicinterest,ambiguityofcollectiv
3、eownership,lowstandardoflandcompensationandlackofjudicialaids.Itwillresultinthedecreaseofcultivatedland,increaseoftheunemployedpopulation,lowstandardeconomic-sociallife,theinfluenceofsocialstabilityandlegitimacyforlocalgovernment.Thepurposeofthispaperistoanalyz
4、ethechoicesofstrategiesamonglocalgovernments,peasantsandcentralgovernment.Currently,localgovernmentsabuseexpropriationpowerandauthorizationpoweroflandleasingasatoolofmaximizingfinancerevenue,governmentactivitiesoftenleadtotortuouslandexpropriation.Theresultshow
5、sthatlandfinancecouldinducelocalgovernmentstoexpandcultivatedlandoccupationinpursuitoffiscalrevenuegrowth,economicdevelopment,localcompetitionandachievementofofficialperformanceevaluation.Thestrategiesofpeasants’choicesaretouseweaponsoftheweak,mobilizechildren,
6、womenandelderstostrengthenthedegreeofthemoralityandlegitimacyfortheirrightsofprotection,andseekenoughresourcesfromsocialelites,choosethebestmomentofsolution,usetherightofrecallandhaverecoursetolaw.Thestrategiesofcentralgovernment’schoicesaretotakeverticalmanage
7、mentoflandresourceunderprovince,establishthearbitrationoflandcompensationandsettlement,constructthesupervisionoflandexpropriationandsoon.Thearticlerevealsthatstrengtheningthepeasants'protectionoftheirrightsandupgradingdegreeofthepunishmentandthreatfromcentralgo
8、vernmentareimportantcountermeasures.Inthemeanwhile,changingthecostofexpectationbenefitfromlocalgovernmentswillbeeffectivetoconstraintheillegalactoflandexpropriationbylocalgo
