1、勞動(dòng)報(bào)酬權(quán)論文：論勞動(dòng)報(bào)酬權(quán)的法律保護(hù)【中文摘要】勞動(dòng)報(bào)酬權(quán)是公民的一項(xiàng)基本人權(quán)和財(cái)產(chǎn)權(quán),歷來(lái)受到我國(guó)政府的高度保護(hù)。尤其是進(jìn)入二十一世紀(jì),隨著經(jīng)濟(jì)快速增長(zhǎng),科學(xué)發(fā)展觀、和諧社會(huì)建設(shè)的提出和人權(quán)入憲,將我國(guó)勞動(dòng)報(bào)酬權(quán)的法律保護(hù)推升到一個(gè)嶄新的高度。面對(duì)社會(huì)經(jīng)濟(jì)發(fā)展和國(guó)家政策的要求,當(dāng)前我國(guó)勞動(dòng)報(bào)酬權(quán)保護(hù)現(xiàn)實(shí)與需求之間差距越拉越大的,在時(shí)代呼喚下,國(guó)家加大了勞動(dòng)報(bào)酬權(quán)的保護(hù),制定了《勞動(dòng)合同法》,并針對(duì)拒不支付勞動(dòng)報(bào)酬行為規(guī)定了拒不支付勞動(dòng)報(bào)酬罪。本文以拒不支付勞動(dòng)報(bào)酬入刑為視角,剖析了勞動(dòng)報(bào)酬權(quán)的內(nèi)涵、該罪的時(shí)代背景,分析

2、了本罪得以成立的法理依據(jù),認(rèn)為拒不支付勞動(dòng)報(bào)酬行為危害了國(guó)家對(duì)勞動(dòng)報(bào)酬權(quán)的保護(hù)制度,誘發(fā)了一系列不穩(wěn)定不和諧的社會(huì)問(wèn)題,促使社會(huì)反思勞動(dòng)報(bào)酬權(quán)法律保護(hù)缺位對(duì)遏制拒不支付勞動(dòng)報(bào)酬的影響。立法機(jī)關(guān)順應(yīng)歷史和民意,增設(shè)拒不支付勞動(dòng)報(bào)酬罪,使國(guó)家保護(hù)勞動(dòng)報(bào)酬權(quán)特別是弱勢(shì)農(nóng)民工報(bào)酬權(quán)、懲治拒不支付勞動(dòng)報(bào)酬,有了更完備的法律制度。同時(shí)應(yīng)正確認(rèn)識(shí)到,國(guó)家工作重點(diǎn)應(yīng)繼續(xù)放在治理上。對(duì)此,法律應(yīng)當(dāng)發(fā)揮作用,注重發(fā)揮刑事、民事、行政和民間調(diào)解的整體合力,既要考慮對(duì)勞動(dòng)者特別是農(nóng)民工的人性關(guān)懷,又要給企業(yè)以喘息的機(jī)會(huì),在兩者利益保護(hù)中把握平衡點(diǎn)
