3、shouldnotissuecommandinghimtocausetobedeliveredtothemrespectivelytheirseveralcommissionsasjusticesofthepeaceinthedistrictofColumbia.Thismotionwassupportedbyaffidavitsofthefollowingfacts;thatnoticeofthismotionhadbeengiventoMr.Madison;thatMr.Adams,thelatepresidentoftheUnitedStates,nominatedt
4、heapplicantstothesenatefortheiradviceandconsenttobeappointedjusticesofthepeaceofthedistrictofColumbia;thatthesenateadvisedandconsentedtotheappointments;thatcommissionsinthedueformweresignedbythesaidpresidentappointingthemjustices,&c.andthatthesealoftheUnitedStateswasindueformaffixedtothesa
5、idcommissionsbythesecretaryofstate;thattheapplicantshaverequestedMr.Madisontodeliverthemtheirsaidcommissions,whohasnotcompliedwiththatrequest;andthat[***2]theirsaidcommissionsarewithheldfromthem;thattheapplicantshavemadeapplicationtoMr.MadisonassecretaryofstateoftheUnitedStatesathisoffice,
6、forinformationwhetherthecommissionsweresignedandsealedasaforesaid;thatexplicitandsatisfactoryinformationhasnotbeengiventothatenquiry,eitherbythesecretaryofstateorbyanyofficerofthedepartmentofstate;thatapplicationhasbeenmadetothesecretaryoftheSenateforacertificateofthenominationoftheapplica
