1、法律碩士專業(yè)學(xué)位論文附條件不起訴制度探微ResearchOnTheDeferredProsecution作者姓名：冉龍超指導(dǎo)教師：房國賓副教授西南政法大學(xué)SouthwestUniversityofPoliticalScienceandLaw內(nèi)容摘要隨著社會高速發(fā)展，刑事犯罪數(shù)量日漸增多以及刑事訴訟程序的逐漸復(fù)雜化，附條件不起訴制度應(yīng)運(yùn)而生，雖然刑事訴訟司法資源的有限是其產(chǎn)生的直接動因，但隨著刑罰理念的慢慢轉(zhuǎn)變、起訴便宜主義的興起，附條件不起訴制度日益顯現(xiàn)其自身的價值內(nèi)涵，于是圍繞附條件不起訴制度的設(shè)立與否成為法學(xué)理論界和實(shí)務(wù)界探究的熱點(diǎn)之一?，F(xiàn)行的刑事訴
2、訟法并被對附條件不起訴作出規(guī)定，發(fā)布的刑事訴訟法修正案草案中規(guī)定，在符合一定條件的情況下，對于未成年人案件可以作出附條件不起訴的決定。在國外的司法實(shí)踐中，附條件不起訴可以有效緩解由于案件量增加而導(dǎo)致司法部門不堪重負(fù)的情形，引入這一制度也有望改變我國不起訴率偏低的情況。本文首先分析了理論知識，在此基礎(chǔ)上，借鑒國外一些關(guān)于附條件不起訴制度的理論知識研究我國司法現(xiàn)狀的附條件不起訴制度。關(guān)鍵詞：刑事訴訟；附條件不起訴制度；法理基礎(chǔ)1AbstractWiththerapiddevelopmentofsociety,thecriminalquantityincreasinga
