2、areformulatedinaccordancewiththeprovisionsofrelevantlawsandregulationsinordertostrengthenadministrationoftheemploymentofforeignersinChina. Article2 ForthepurposesoftheseRegulations，theterm“foreigners”shallrefertopersonswhodonothaveChinesecitizenshippursuanttotheprovisionsofthePRC，National
3、ityLaw. ForthepurposesoftheseRegulations，theterm“employmentofforeignersinChina”shallmeantheactsoflawfulengagementinsociallabourandobtainingoflabourremunerationinsidethePeople'sRepublicofChinabyforeignerswhodonothavetherightofpermanentresidence. Article3 TheseRegulationsapplytoforeignerse
4、mployedinsidethePeople'sRepublicofChinaandworkunitsinsidethePeople'sRepublicofChinawhichemployforeigners. TheseRegulationsdonotapplytopersonnelofembassiesandconsulatesofforeigncountriesinthePeople'sRepublicofChina，therepresentativeofficesoftheUnitedNationsinthePeople'sRepublicofChinaandot
5、herinternationalorganizationswhoenjoydiplomaticprivilegesanddiplomaticimmunity. Article4 ThelabouradministrationauthoritiesofthePeople'sGovernmentsofeachprovince，autonomousregionandmunicipalitydirectlyunderthecentralgovernmentandthelabouradministrationauthoritiesattheregionalandmunicipall
6、evelauthorizedbythemshallberesponsibleforadministrationoftheemploymentofforeignersinChina. PARTTWO EMPLOYMENTPERMITS Article5 Tohireaforeigner，theemployingunitmustapplyforanemploymentpermitforsuchforeigner，andmayhiresuchforeigneronlyafterobtainingapprovalandaForeigner'sEmploymentPermitof
7、thePeople'sRepublicofChina（hereafter“Permit”）。Article6 Thepositionforwhichaforeignerishiredbytheemployingunitshallbeapositionforwhichtherearespecialrequirements，forwhichthereisatemporaryshortageofsuitablecandidatesinsideChinaandwhichdoesnotviolaterelevantstate
