1、中文摘要中國(guó)慈善思想從古代起就發(fā)展成為中國(guó)人民的道德理念和價(jià)值信仰，但慈善作為～項(xiàng)事業(yè)，其法制化卻是從民國(guó)時(shí)期才開始的。中國(guó)慈善事業(yè)起步晚，發(fā)展緩慢，慈善事業(yè)的立法大多借鑒于西方發(fā)達(dá)國(guó)家的經(jīng)驗(yàn)，沒(méi)有形成完整的法律體系。隨著經(jīng)濟(jì)的發(fā)展，公民慈善意識(shí)的增強(qiáng)，企業(yè)已成為捐贈(zèng)的主力，個(gè)人捐贈(zèng)仍有巨大潛力有待開發(fā)。隨著慈善組織的興起，慈善捐贈(zèng)涉及到三方法律關(guān)系：捐贈(zèng)者、慈善組織、受益人成為慈善捐贈(zèng)法律關(guān)系的主體。本文通過(guò)對(duì)慈善文化傳統(tǒng)的思考、對(duì)發(fā)展現(xiàn)狀、發(fā)展困境進(jìn)行分析，以中外慈善制度比較出發(fā)，分析了中國(guó)慈善捐贈(zèng)缺失的法律制度原因，提出了制
