1、中文摘要目前，犯罪嚴(yán)峻形勢(shì)和司法資源的缺乏之間的矛盾越來(lái)越突出，主要的原因是社會(huì)和經(jīng)濟(jì)發(fā)展，犯罪類型不斷增加，導(dǎo)致犯罪率飆升。類似的社會(huì)和法律問(wèn)題已經(jīng)出現(xiàn)在美國(guó)、日本、德國(guó)等地，但他們使用的附條件不起訴制度取得了很好的效果?！缎淌略V訟法》修改前的改革中，由于缺乏統(tǒng)一規(guī)定，各試點(diǎn)單位附條件不起訴程序也存在很多分歧，導(dǎo)致該制度的應(yīng)用不統(tǒng)一，對(duì)附條件不起訴制度的建立有一定影響。新《刑事訴訟法》關(guān)于附條件不起訴制度適用的規(guī)定標(biāo)志著我國(guó)附條件不起訴制度已經(jīng)走向成熟的道路。對(duì)于保護(hù)未成年人，預(yù)防未成年人犯罪，節(jié)約司法資源，提高訴訟效率都有所裨益。并且該項(xiàng)制度也體現(xiàn)了司法的民主精神。但是該制度也存在一些問(wèn)
