2、greeMasterUniversityXiangtanUniversitythDateNovember,272017萬方數(shù)據(jù)萬方數(shù)據(jù)摘要司法機(jī)關(guān)是社會(huì)公平正義的守護(hù)神，對(duì)社會(huì)風(fēng)尚和民眾的價(jià)值觀具有重要的引導(dǎo)作用，司法過程中出現(xiàn)錯(cuò)案往往招致輿論猛烈的批評(píng)和聲討，錯(cuò)案追究活動(dòng)是對(duì)司法公正形象的一次重塑，往往成為社會(huì)輿論關(guān)注的焦點(diǎn)和重點(diǎn)。隨著信息時(shí)代和自媒體時(shí)代的到來，信息技術(shù)和新媒體大大強(qiáng)化了輿論的影響力，網(wǎng)絡(luò)條件下的輿論能夠聚沙為塔，以其廣泛的影響力改變社會(huì)情緒，甚至能夠影響案件的走向和最終處理,社會(huì)輿論具有形成的自發(fā)性、發(fā)展中的
3、可引導(dǎo)行、影響的廣泛性，通過分析可以發(fā)現(xiàn)，那些經(jīng)過社會(huì)溝通與交流，態(tài)度大致相近的社會(huì)輿論，對(duì)于錯(cuò)案追究活動(dòng)具有建構(gòu)性和消解性作用，健康、理性的社會(huì)輿論能夠監(jiān)督錯(cuò)案追究依法運(yùn)行，促進(jìn)司法公開和法制的完備，而非理性的社會(huì)輿論會(huì)干擾正常的司法活動(dòng)，侵害錯(cuò)案責(zé)任人的合法權(quán)益，從而消減錯(cuò)案追究的公正性。因此，研究社會(huì)輿論在錯(cuò)案追究中的作用，在社會(huì)輿論與錯(cuò)案追究之間嫁接理性的橋梁，發(fā)揮輿論在錯(cuò)案追究過程中的建構(gòu)性作用，才能更好的健全輿論與司法的良性互動(dòng)，促進(jìn)我國(guó)的民主法治建設(shè)。關(guān)鍵詞：社會(huì)輿論；錯(cuò)案追究；司法監(jiān)督；司法公信力I萬方數(shù)據(jù)Abst
