2、nExchangeControlandotherlawsandadministrativeregulationsforthepurposesofstrengtheningthesupervisionofoverseasuseofforeignexchangeinsurancefunds，preventingrisksandprotectingtheinterestsoftheinsured.Article2AninsurancecompanyintheseMeasuresreferstoaChineseinsurancecompany，awhollyforeign-ownedin
3、surancecompany，aSino-foreignjointventureinsurancecompanyorabranchofforeigninsurancecompanyestablishedwiththeapprovalfromtheChinaInsuranceRegulatoryCommission（hereinafterreferredtoasthe“CIRC”）andregisteredinaccordancewiththelaw.ForeignexchangeinsurancefundsintheseMeasuresrefertotheaggregatecap
4、ital，commonreserve，undistributedprofit，reservesandguaranteedepositsreceivedbyaninsurancecompanythataredenominatedinforeignexchange.Article3Aninsurancecompanyengagedinoverseasuseofforeignexchangefundsshallabidebytheprinciplesofsafety，liquidityandprofitability，makeinvestmentprudentlyandcarryout
5、independentoperationatitsownrisks.Article4Aninsurancecompanyengagedinoverseasuseofforeignexchangefundsshallcomplywithlawsandadministrativeregulationsoninsuranceandforeignexchangecontrol，theseMeasuresandrelevantoverseaslawsandregulations.Article5TheCIRCandtheStateAdministrationofForeignExchang
6、e（hereinafterreferredtoasthe“SAFE”）shallconductsupervisionandregulationofoverseasuseofforeignexchangeinsurancefundsaccordingtolaw.ChapterIIQualificationsArticle6Aninsurancecompanyengagedinoverseasuseofforeignexchangefundsshallsatisfythefollowingrequirements：（1）Ithasapermitforconductingforeign
7、exchangebusiness；（2）ItstotalassetsattheendofthepreviousyeararenotlessthanRMB5billion；（3）ItsforeignexchangefundsattheendofthepreviousyeararenotlessthanUSD15millionorequivalentvalueinafreelyconvertiblecurrency；（4）Itssolvencymargincomplieswithre
