3、posealengthofimprisonmentthatbothprotectsthepublicandsufficientlyreflectsthestateofmindoftheoffenderatthetimeofthekilling.Inthecaseofmotoraccidentdeaths1,thecourtsadmittedlyfaceaseriousdifficulty.Usuallythesentencerisnotdealingwithcriminalsassuch,butlaw-abidingcitizenswho,apartfro
4、mtheirinvolvementintheoffence,wouldnototherwisedreamofcommittingacrime.2However,wheneverdeathresultsfromdangerousdriving,gravedistressisoftencausedtothefamilyofthedeceasedandtheimpactonpeople’slivesmustbetakenintoaccountwhensentencing.Itisalsoimportanttohaveinmindadeterrenteffectw
5、hensentencing,takingintoaccounttheoverallcircumstancesandtheculpabilityoftheoffender.Aseveresentenceisjustifiedwhereapersonhasdrivenwithselfishdisregardforthesafetyofotherroadusersorhisorherpassengers.Aclearrecord,goodcharacterandsenseofremorsearerelevantconsiderations,buttheyshou
6、ldnotbegivenundueprominence.3Thesesentimentswereexpressedbytheappellatecourtsinappealsagainstsentenceinroaddeathcasesheardin2010.Infact,overtheyears,aseriesofapplicationsforreviewofsentencewerebroughtundersection81AoftheCriminalProcedureOrdinance,Cap.221,aproceduredeployedsparingl
