2、gtheneutralityofthearrestprocedure.Theoristsandpractitionershaveputforwardvariousproposalsforreforminhopethatthedecision-makingprocessofthearrestwouldbeimproved.Thetheoristsappealintenselythatthejurisdictionofarrestofdutycrimeshouldbeattributedtothecourt
3、.However,fromourcountry’sreality,therearemanydisadvantagesifthecourthasthejurisdictionofarrest.Fromsystemperspectiveandpracticaloperationallevel,thisproposalisnotoperableintheshortterm.Inviewofoneinvestigateitselftoarresthavetoomanydisadvantagesandcourth
4、avethejurisdictionofarrestisnotoperable,SupremePeople'sProcuratoratebasiscentraldeploymenthascarriedonthereformtothearrestprocedureofdutycrime.SupremePeople'sProcuratoratedecidebelowtheprovinciallevelthePeople'sProcuratoratehandlesdutycrime,thearrestdeci
5、sion-makingpowerexercisesbyonfirst-levelPeople'sProcuratorate.Thecrimebytakingadvantageofdutycasearrestsinthedecision-makingpowertoraisefirst-levelhastherelativerationalityandthevalidity.But,wemustrealizethequestionwhichexiststothereform,andtakestheeffec
