1、商標是商事主體用以區(qū)別商品或者服務(wù)來源的標記,也是其商譽的載體,是經(jīng)營者重要的無形資產(chǎn),故商標對商事主體的重要的經(jīng)濟價值和戰(zhàn)略地位毋庸置疑。國家制定商標法或加入保護知識產(chǎn)權(quán)的國際公約組織,建立商標注冊管理制度,其根本目的就是為發(fā)揮商標的區(qū)分商品或服務(wù)來源的功能,維護市場經(jīng)濟秩序及消費者合法權(quán)益。然而,商標搶注現(xiàn)象卻與商標注冊取得制度相伴而生,特別在實行商標注冊在先申請原則的中國,商標搶注現(xiàn)象尤其泛濫。雖然商標搶注行為有促進商事主體提高商標保護意識與積極申請商標注冊的一面,也可能存在嚴重影響市場競爭秩序,損害商標權(quán)
2、利人的合法權(quán)利的…面。故需對商標搶注行為剖析區(qū)分,既要鼓勵商事主體依法積極申請注冊新商標,建立商標戰(zhàn)略體系,創(chuàng)建核心競爭品牌,也要嚴厲打擊商標惡意搶注行為。這就需要對商標惡意搶注行為有一個明確的認知,只有明確什么是其構(gòu)成要件,準確界定惡意行為,才能有效的打擊遏制商標的惡意搶注,維護市場秩序正常運行。然而我國在規(guī)范商標搶注行為的法律制度還存在諸多不足,對惡意搶注的規(guī)定分散不成系統(tǒng),需加以研究完善,以便在實踐中更好得保護商標權(quán)利人及消費者的權(quán)益。本文從商標惡意搶注司法實踐中的兩個典型案例分析出發(fā),引出問題,通過法律分
