1、中文摘要盜竊罪在刑事案件中的發(fā)案率居于首位，所以，正確認(rèn)定盜竊罪的既遂與未遂就顯得至關(guān)重要。但盜竊罪既遂形態(tài)的認(rèn)定標(biāo)準(zhǔn)在理論上沒有形成統(tǒng)一的標(biāo)準(zhǔn)，給司法實(shí)務(wù)帶來了很多困難。因此，進(jìn)行盜竊罪的既遂標(biāo)準(zhǔn)研究具有重要的現(xiàn)實(shí)意義。本文從犯罪既遂標(biāo)準(zhǔn)的一般理論入手，系統(tǒng)評(píng)析了關(guān)于盜竊罪既遂標(biāo)準(zhǔn)的八種學(xué)說，并比較了各種學(xué)說的利弊，運(yùn)用刑法的理論總結(jié)出失控說能更好的保護(hù)權(quán)利人的財(cái)產(chǎn)利益，以失控說作為判斷盜竊罪既遂與未遂的標(biāo)準(zhǔn)更加合理科學(xué)，筆者也對(duì)失控說的合理性進(jìn)行了進(jìn)一步的論證，最后，筆者以引入案例的形式，從理論到實(shí)踐，運(yùn)用失控說進(jìn)一步解決實(shí)踐中各種盜竊形態(tài)的既遂認(rèn)定問題。關(guān)鍵詞：犯罪既遂；盜竊既遂；失控
