1、摘 要 票據(jù)行為無(wú)因性,是指票據(jù)如果具備了《票據(jù)法》上所規(guī)定的條件,票據(jù)權(quán)利即可成立。至于票據(jù)行為賴以產(chǎn)生的原因,則在所不問(wèn)。無(wú)論其后發(fā)生何種變化,均不影響票據(jù)權(quán)利的成立。應(yīng)該說(shuō),票據(jù)行為無(wú)因性,構(gòu)成了票據(jù)理論的基礎(chǔ),是票據(jù)法的生命力所在。世界各國(guó)和地區(qū)的票據(jù)法以及國(guó)際上票據(jù)法的有關(guān)條約、公約規(guī)定,皆以堅(jiān)持票據(jù)行為的無(wú)因性作為票據(jù)立法的原則?!〉覈?guó)學(xué)術(shù)界對(duì)這一問(wèn)題的探討始終沒(méi)有深入進(jìn)行,另外我國(guó)票據(jù)法中的無(wú)因性規(guī)定存在不足,只是一定前提條件下的無(wú)因性,所以這一問(wèn)題在票據(jù)立法和司法實(shí)踐中一直處在
2、模糊和混亂狀態(tài),本文對(duì)票據(jù)行為的無(wú)因性給予理論闡釋?zhuān)容^世界各國(guó)和地區(qū)的票據(jù)無(wú)因性規(guī)定,并在此基礎(chǔ)上分析我國(guó)票據(jù)法規(guī)定中的缺陷,提出完善我國(guó)票據(jù)無(wú)因性的立法構(gòu)想,以此求得對(duì)票據(jù)無(wú)因性的正確理解和理性思考?!≡诘谝徊糠郑紫冉榻B了票據(jù)行為無(wú)因性的歷史創(chuàng)設(shè)過(guò)程和歷史背景。票據(jù)作為商品經(jīng)濟(jì)的產(chǎn)物,隨著經(jīng)濟(jì)的發(fā)展充分發(fā)揮了其支付和流通的職能,并衍生出多種經(jīng)濟(jì)職能,如信用、結(jié)算、融資等職能,而票據(jù)的無(wú)因性原則就在于確保交易的安全,同時(shí)也使票據(jù)的流通更為便捷,降低持票人的風(fēng)險(xiǎn),從而促進(jìn)經(jīng)濟(jì)更快發(fā)展。 要準(zhǔn)確理解
